Terms & Conditions

Le Creuset Australia Pty Ltd (“Le Creuset”) is a company registered in Australia with company registration number ABN 87142378327 and whose registered office is at Suite 4, Level 4, 601 Pacific Highway, St Leonards, NSW 2065, Australia. This agreement is a contract between the customer (“you”) and Le Creuset. These terms and conditions apply to the ordering, purchase, fulfilment and delivery of products from our website www.lecreuset.com.au. Please read the following terms and conditions carefully before placing your order with Le Creuset. You agree to be bound by these terms and conditions when you submit an online order with Le Creuset. Each order you place will be a separate and binding agreement between you and Le Creuset with respect to the supply of products, in accordance with these terms and conditions.

Placing an order

The steps required to create the contract between you and Le Creuset are as follows:

  • You place the order for your products on the Web Site by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Web Site.
  • Le Creuset will send to you an confirmation email detailing the products you have ordered. This is not an order acceptance from Le Creuset.
  • As your product is shipped from our warehouse we will send you a despatch confirmation email.
  • Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the products ordered and successful processing of your payment unless we have notified you that we do not accept your order, or you have cancelled it in accordance with these terms and conditions. You acknowledge that all orders through the Web Site are with respect to products intended for personal and domestic use only and are not for commercial use for resale.

Non-acceptance of an order by us may be a result of one of the following:

  • The product you ordered being unavailable from stock.
  • Our inability to obtain authorisation for your payment.
  • The identification of a pricing or product description error.
  • Your not meeting the eligibility to order criteria set out in the main terms and conditions.

Order cancellation

Unless provided for under these terms and conditions, no cancellations or changes to orders will be accepted, and the products will be delivered to the stated delivery address in accordance with these terms and conditions. Therefore, you should carefully check that your order is accurate before you submit it to us. You will, however, be able to return products in accordance with the returns policy set out in Returns and Refunds section of these terms and conditions. The returns policy forms a part of these terms and conditions. Please follow the procedure set out in our Returns & Refunds section.

Prices

All prices displayed on the Web Site will be in Australian dollars and be inclusive of Australian GST at the prevailing rate, but exclude delivery costs, which will be added to the total amount due. The applicable delivery costs will be clearly displayed on the Web Site during the checkout process. Due to the large number of products on our Web Site it is possible that some of the products listed on our site may be incorrectly priced, despite our best efforts. If we discover there is a pricing error we will normally, at our discretion, either contact you and give you the option of reconfirming your order at the correct price or cancel the order, or reject your order and notify you of the rejection. Prices (including delivery fees) are subject to change without notice, and you acknowledge that subsequent purchases of the same product cannot be guaranteed at the same price.

Entrants will be deemed to have accepted these terms and conditions and to agree to be bound by them when entering this competition which is a prize draw and the promoter of this prize draw is Le Creuset Australia Pty Ltd, Suite 4, Level 4 601 Pacific Highway, St Leonards 2065, NSW, Australia.
    2. In the event of any dispute relating to this prize draw, the decision of Le Creuset Australia shall be final and no correspondence or discussion shall be entered into.
    3. This prize draw is open only to Australian residents aged 18 and over. Only one entry per person will be accepted. Employees of Le Creuset Australia or any subsidiary or associated companies involved in this prize draw or any agents or members of their families or households, are not eligible to enter the prize draw.

    Delivery information

    Orders placed on the Web Site can only be delivered to Australian postal addresses (residential addresses and business addresses). We are unable to deliver to PO Box addresses.

    A flat rate of $10.00 applies to all orders across Australia.

    Delivery will be made via our Delivery Agent to the shipping address that you nominate during the checkout process. Most orders are processed and dispatched within 1-2 working days of the order being placed. Please note that business days are Monday to Friday, but exclude public holidays and bank holidays in NSW, Australia.

    Estimated shipping times are as follows:

    NSW and ACT: 2-5 days

    QLD: 4-7 days

    VIC: 4-7 days

    SA: 4-7 days

    TAS: 7-10 days

    WA: 7-10 days

    NT: 7-10 days

    You acknowledge and agree that notwithstanding anything else in this sections:
    (a) Le Creuset cannot guarantee that delivery will occur in the delivery time frames specified above;
    (b) delivery time frames may change from time to time due to unforeseen circumstances; and
    (c) Le Creuset is not liable with respect to any loss, damage, cost, expense or injury you or any third party suffers as a result of a change in delivery times or a delay in delivery.

    If you are not personally available to accept delivery, you may appoint a representative to do so in your place. The representative must be over 16 years of age and capable of receiving delivery on your behalf, and you agree that we will be entitled to rely on the representative's instructions as if they were your own.

    On delivery, the Delivery Agent may require you or your nominated representative to provide them with proof of identity, such as photo identification or proof of age. Le Creuset may not make delivery of the products if the person receiving the products is unable or unwilling to provide satisfactory evidence of proof of identity or age. Where delivery cannot take place due to insufficient identification, a calling card will be left for you to collect the products from a local Australia Post office. It is your responsibility to follow the instructions stated on the calling card.

    You or your nominated representative may be requested by the Delivery Agent to sign a delivery manifest to confirm that the delivery has taken place. If you refuse to sign the delivery document, this will be taken as a refusal to accept the delivery. Where redelivery is required because of refusal to accept delivery, you may be required to pay any associated fees for redelivery.

    If there is no one available at the delivery address to accept delivery, or there is limited access to the delivery address or it is unsafe or impractical to make delivery, a calling card will be left for you to collect the products from a local Australia Post office. It is your responsibility to follow the instructions stated on the calling card.

    Risk and title in the product passes to you on the date and time of delivery of the products to the Delivery Agent.

    Returns and refunds

    Should you wish to return anything bought from us online, please contact our friendly Customer Service team no later than 7 days after receipt of your order to start the return process. Call our Australia freephone line 1 300 767 993, open from Monday – Friday between 9am and 5pm. Or, if you prefer you can email us on Customer Services.
    When you contact us we will establish the reason for the return and send you an email including your Related CQ number, return address information as well as a returns note.

    Ensure you return your items unused and undamaged with any labels still attached in their original packaging. The original despatch note or the returns note needs to be included. If we find that the products have not been returned to us in fully re-saleable condition, we reserve the right to refuse a refund on the item. Please note we are not responsible for return postage other than for incorrect or faulty items. Neither can we accept responsibility for packages that never reach us, so we advise you to use a traceable and insured service to return your product to us.

    Upon receipt of your returned product we will arrange a refund to the card used to place the original order. We will process your return as quickly as possible. However, during very busy periods, please allow between 6 - 10 working days for your return to be processed. We are not responsible for any delays in refund caused by banks, or credit card/direct debit service providers.

    You acknowledge and agree that Le Creuset cannot process exchanges for products bought online and we do not give refunds or exchanges of products bought in our retail stores.

    Your consumer statutory rights are not affected by this returns policy.

    Payment

    When purchasing products online a valid payment method must be used at the time. We accept payment with the following credit or debit cards: Visa and MasterCard. We do not accept Diners or American Express credit cards.

    We are working on offering PayPal as a payment method.

    We do not accept cash, cheques, gift cards or vouchers as payment online. By submitting an order to us through our site, you are confirming that the payment details provided on your order are valid and correct. All transactions will be in Australian dollars. Non-Australian credit card providers and banks will determine the exchange rates to be applied and may add an additional processing or administration charge in relation to such payments which non-Australian card holders will be liable to pay.

    We will charge your credit or debit card at the time that we despatch your order.

    Description and Availability of Products

    Whilst we take the utmost care to ensure the product descriptions, pictures, information and prices are accurate we do not accept liability for any inaccuracies, errors or omissions.

    Stock availability will be shown on the Web Site, and whilst while we endeavour to ensure products are always available, there may be times when products will be temporarily out of stock. In these instances there is an option that can be selected and you emailed when the product is back in stock.

    You acknowledge and agree that:

    • all pictures and images of products displayed on the Web Site are for illustration purposes only;
    • you have read any corresponding written description of the products prior to submitting your order;
    • the colour of products as shown on the Web Site may vary slightly in shade for the actual produc;
    • where we provide dimensions and measurements in the descriptions of a product (where applicable or available), it is your responsibility to ensure that the actual size of each item is suitable for your purpose prior to submitting your order; and
    • any accessory featured with the product is for illustration purposes only, and may be sold separately.

    Our Liability to You

    Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

    The benefits given by any warranty given with a purchased product are in addition to other rights and remedies of the consumer under a law in relation to the goods or services to which this warranty relates.

    Subject to any rights you have under any Australian consumer protection law, Le Creuset excludes to the fullest extent possible, all implied terms and warranties whether statutory or otherwise, relating to the subject matter of these terms and conditions. You are entitled to certain rights under consumer protection law that cannot be excluded. Our liability to you for loss or damage of any kind arising out of these terms and conditions will be reduced or limited to the extent (if any) that you cause or contribute to the loss or damage.

    Your Responsibilities

    You represent and warrant to us that:

    • all information (including personal information) and data provided by you to us through the Web Site is true, accurate, complete and up to date, and (where relevant) you have obtained the consent of your nominated recipient for gifts to provide their personal information to Le Creuset;
    • any nominated representative receiving the products on your behalf at the delivery address is duly authorised by you to do so;
    • you are over the age of 16; and
    • in placing your order, you have read and agree to these terms and conditions.

    Privacy and Security

    We promise to respect your privacy and we will ensure that your personal details are held securely and in strict confidence, in accordance with the Privacy Act 1988 (Cth).

    Opt-In

    Le Creuset provides an opt-in option if you want to receive emails from us regarding new services and products offered on the Web Site, or if you want to receive information from third parties. The opt-in choice may be exercised at the points where personal information is collected by selecting the appropriate checkbox, or, if you have an account with us, via the My Account section of the Web Site.
